By means of present writ petition, petitioner has sought following reliefs:
a. Issue a writ, order or direction in the nature of mandamus commanding upon the Special/Additional District Judge, Ballia to decide the Execution Case No. 10 of 2008 (Ramagya Rai Vs. State of U.P. and Others) within a stipulated time framed by this Hon'ble Court.
b. Issue a writ, order or direction in the nature of mandamus commanding/directing the District Magistrate/Collector, Ballia to ensure the payment of compensation amount a warded in favour of the petitioner in pursuance to the orders/recovery certificates issued by the Special/Additional District Judge, Ballia, forthwith.
The only prayer of the petitioner in this writ petition is to direct the Special /Additional District Judge, Ballia to decide the execution case no. 10 of 2008 within stipulated time.
Considering the aforesaid facts and circumstances of the case and keeping in view that the case is pending since 2008, the writ petition is disposed of with direction to respondent no. 4, Special/Additional District Judge, Ballia to consider and decide the Execution Case No. 10 of 2008 (Ramagya Rai v. State f U.P. and Others) preferably within three months from the date of production of certified copy of this order provided there is no legal impediment.
