JUDGMENT / ORDER

The petitioner herein is the defacto complainant in Crime No.1378/2014 of the Ochira Police Station, registered under Sections 143, 147, 341, 452, 323 and 427 IPC r/w 149 of the Indian Penal Code. The respondents 3 to 5 herein are the identified accused in the crime. The defacto complainant now seeks orders quashing the prosecution on the ground that he and the accused have settled the dispute amicably. The respondents 3 to 5 are represented by counsel.
2. The learned counsel for the petitioner submits that the alleged incident happened due to some misunderstanding, and that the complainant happened to file complaint on some misapprehension. Anyway, the parties have amicably come to terms and the complainant does not want to prosecute the matter further. I find that there is a real and genuine settlement between the parties and that continuance of prosecution will do harm and hardship to both the parties.
In the result, this Criminal Miscellaneous Case is Crl.M.C No.4941 of 2014 2 allowed. The FIR and the further proceeding in Crime No.1378/2014 of the Ochira Police Station will stand quashed under Section 482 of the Code of Criminal Procedure.
