Srikanth, Adv. for R-2) …Respondents This Writ Petition is filed under Article 226 of Constitution of India, praying to direct the respondents to consider representation dated 05.04.2017 (Annexure- K and L), 30.04.2018 and 04.05.2018 (Annexure-O and P) and promote the petitioner regularly to the post of Asst. Executive Engineer and etc., This Writ Petition coming on for Orders, this day, the Court made the following:-
ORDER With the consent of learned counsel for the parties, the matter is taken up for final disposal.
2. Petitioner has sought for the following reliefs:
i) Issue appropriate writ or order or direction directing the respondents to consider representation dated 05.04.2017 (Annexure-K and L), 30.04.2018 and 04.05.2018 (Annexure- O and P) and promote the petitioner regularly to the post of Asst. Executive Engineer in the interest of justice and equity.
ii) Pass such other order or direction deems fit in the circumstances of the case may be including award of costs in the interest of justice and equity.
3. Petitioner’s grievance is that he is entitled for the promotion to the cadre of Assistant Executive Engineer. The concerned respondent has not taken any action on the petitioner’s grievance even though he submitted three representations and so also, objections have not been filed by the concerned respondent so as to whether the petitioner is eligible for promotion to the post of Assistant Executive Engineer or not.
4. Therefore, promoting Authority is hereby directed to consider the petitioner’s grievance relating to promotion to the cadre of Assistant Executive Engineer, if he is otherwise eligible, promote him or in the alternative, necessary speaking order shall be passed. The above exercise shall be completed within a period of two months from the date of receipt of copy of this order.
With the above observations, writ petition stands disposed of.
Consequentially, I.A. No.1/2019 for direction does not survive for consideration and stands disposed of.
