Ms.Shah, learned APP waives service of rule on behalf of the respondent-State.
By the present application, the applicant-convict has prayed that he be enlarged on temporary bail on the ground that he wants to take care of ailing son who has medical complications because of the accident which has taken place in the year 2004.
We find that the ailment is quite old, coupled with the fact that applicant -convict was already released on furlough for the period from 23rd October, 2011 to 5th November, 2011 and during that period, he could have done necessary things which he wants to do now.
Under the circumstances, the discretion does not deserve to be exercised.
Hence, application is rejected. Rule discharged.
