Heard Sri Anupam Kulshreshtha, learned counsel for the petitioners, learned standing counsel for the respondent nos. 1 to 6 and Sri V.K.Singh, learned senior counsel assisted by Sri S.Shekhar, learned counsel for respondent no.7.
Sri V.K.Singh, learned senior counsel, who appears for respondent no.7 states that the Regional Manager, Central Region, Uttar Pradesh Forest Nigam, Lakhimpur Kheri has no concern with the dispute in the present writ petition.
Learned counsel for the petitioners states that the land in question was donated by the Ex Zamindars under the Bhoodan Yojna Act, 1952 and the land stood transferred to the reserve forest under the Indian Forest Act, 1927 and is now vested in the Pilibhit Tiger Reserve Sanctuary.
The petitioners are stated to have purchased the trees over the land in question but because of difficulty in getting permission to cut the trees they are now demanding compensation for its trees.
In our opinion the claim of the petitioners may at best be decided by the respondents themselves.
No useful purpose will be served by keeping the matter pending.
We, therefore, dispose of this writ petition with the direction that if the petitioners file a fresh representation before the Chief Conservator of Forest and Regional Director, Social Forestry, Bareilly Region, Bareilly, respondent no.3 along with a certified copy of this order within 15 days from today in respect of the claim raised herein, the respondent no.3 shall consider and decide the claim of the petitioners in accordance with law expeditiously preferably within a further period of 3 months.
It is made clear that the Court has not adjudicated the claim of the petitioners on merits.
