The petitioner has assailed the suspension order dated 24.6.2019 passed by the District Supply Officer, Maharajganj by submitting that the Government Order dated 29.7.2004 was not complied with inasmuch as the suspension order did not mention as to whether the inquiry would result in a grave punishment of cancellation of the licence. In support of his argument learned counsel for the petitioner relied upon 2018 (4) ADJ 789 : Hublal Shah @ Hublal Sahu Vs. State of U.P. & Ors. Further, he submitted that the suspension order was passed in violation of the Government Order dated 13.4.2017 inasmuch as the approval of the District Magistrate was lacking.
Learned Standing Counsel, however, in reply submitted that had the petitioner approached the Court at the relevant time then interference could have been done by this Court but at this belated stage no interference is warranted.
Having heard learned counsel for the parties, I am of the definite view that no interference, at this stage, is warranted, specially when the petitioner has filed his reply to the show- cause notice.
Under such circumstances, it is directed that the inquiry itself be concluded within a period of one month from the date of production of a certified copy of this order. The writ petition is, accordingly, disposed of.
