Heard Sri Bhola Nath Yadav, counsel for the petitioner and learned Standing counsel.
By this petition, the petitioner seeks a direction in the nature of mandamus commanding the respondent no.1 Consolidation Officer, Sadar District-Jaunpur, to decide the restoration application moved by the State of U.P. through Assistant District Government Counsel Revenue against the order dated 15.7.1976 passed in Case No. 1553 of 1976, within a stipulated period of time.
Contention of learned counsel for the petitioner is that the objection filed by the petitioner under Section 9-A (2) of the U.P. Consolidation of Holdings Act was allowed by the Consolidation Officer vide order dated 15.7.1976 and after more than 36 years, the application for recalling the said order was moved by the State of U.P. on 14.7.2018 which is still pending.
In the facts and circumstances of the case, direction is issued upon respondent no.1 Consolidation Officer, Sadar District- Jaunpur, to decide the restoration application filed by the State of U.P. through Assistant District Government Counsel Revenue for recalling order dated 15.7.1976 passed in Case No. 1553 of 1976 in accordance with law expeditiously, preferably within period of six months from the date of production of a certified copy of this order.
With the above direction, the writ petition stands finally disposed of. No order as to costs.
