Heard learned counsel for the petitioner.
In view of the order proposed to be passed, notices need not go to the private respondents.
The learned counsel for the petitioner has confined his prayer only to the effect that a direction be issued to the Civil Judge (J.D.), East, Allahabad to decide the 6-C application for temporary injunction filed in Original Suit No.1614 of 2021 (Rama Shankar Vs. Mahendra Kumar & others) within stipulated period.
It is argued by counsel for the applicant that application for grant of interim order was filed in which notices were issued to the opposite parties vide order dated 06.07.2021. By the aforesaid order 06.08.2021 was the date fixed and on 06.08.2021 next date fixed in the matter is 7.10.2021. It is further argued that interim injunction is urgently required in favour of the petitioner.
In view of the same, petitioner is permitted to move fresh application for early disposal of the injunction application pending in the civil suit along-with copy of this order within two weeks for early hearing of the injunction application. If such an application is filed, the court below is directed to pass appropriate orders on the same expeditiously and preferably within a period of three weeks.
