Heard Sri N.K. Pandey, learned counsel for the applicant and Sri Ved Byas Mishra, learned counsel for opposite party.
The applicant is before this Court for a direction to initiate contempt proceeding against the opposite party for wilful disobedience of the judgement and order dated 28.01.2011 passed in Writ Petition No.5110 of 2011 (Rama Shankar Singh Vs. State of U.P. and others).
It is argued argued by learned counsel for the applicant that in compliance of the aforesaid order, various orders dated 06.06.2011, 08.09.2011 and 29.06.2019 were passed by the opposite party. It is argued that aggrieved against the aforesaid orders, the applicant has preferred a fresh Writ Petition No.14894 of 2019 (Rama Shankar Singh Vs. State of U.P. and others).
It is admitted between the parties that the fresh writ petition challenging the orders dated 06.06.2011, 08.09.2011 and 29.06.2019 is still pending before this Court.
In view of the above, this court is of the opinion that since a fresh writ petition has already been filed by the applicant challenging the orders dated 06.06.2011, 08.09.2011 and 29.06.2019 passed by the opposite party in compliance of the order dated 28.01.2011 passed by this Court in Writ Petition No.5110 of 2011, therefore, no further cause of action would required.
Accordingly, the present contempt application is dismissed.
