JUDGMENT / ORDER

Heard learned counsel for the applicant and learned A.G.A. for the State.
Notice on behalf of the respondent no. 1 has been accepted by learned A.G.A, who prays for and is allowed four weeks time to file counter affidavit.
Issue notice to respondent no. 2, who may also file counter affidavit within same period, rejoinder affidavit may be filed within two weeks thereafter.
List after two months.
Subject to the applicant depositing the 50% arrears of maintenance at the awarded rate with the Principal Judge, Family Court, Bareilly within two months from today, which shall be paid to the opposite party no. 2 and his continuing to pay current maintenance to her at the rate of Rs.1600/- per month on or before the 10th day of each succeeding month, the execution and operation of the order dated 13.11.2010 passed by Principal Judge, Family Court, Bareilly in Misc. Case No. 199 of 2009, under Section 125 Cr.P.C. shall remain stayed.
In case of default, this interim order shall stand automatically vacated.
