After the filing of an application under section 10 on 4.8.1991, the petitioner participated in the proceedings of the suit. Now, at this belated stage, he cannot press the application.
However, if the petitioner is so advised, he may file an application under Order IV-A C.P.C. for the consolidation of the instant suit along with Suit No.824 of 1988.
The writ petition is, accordingly, dismissed.
