This application is filed praying for condonation of delay which is taken place in preferring the Second Appeal. The Second Appeal is directed against the judgment and order dated 17th October, 2012 passed by learned Principal District Judge, Anand in Regular Civil Appeal No.47 of 2012.
It has been averred in the application that certified copy of the order was applied immediately on 20th October, 2012 to file appeal. The time was consumed in seeking legal advise and by the time advocate was engaged to file appeal, it was delayed by 22 days. It is also averred that relative of the advocate had expired due to which further time passed by.
Having heard learned advocate for the parties, it cannot be said that there is no satisfactory explanation for 22 days. Sufficient cause is made out from the averments in the application. Hence, delay of 22 days caused in preferring Second Appeal is condoned. Rule is made absolute.
At the request of learned advocate for the appellant, Second Appeal (Stamp) No.51 of 2013 may be notified for admission board on 26th April, 2013.
