1. By way of this petition under Article 226 of the Constitution of India, the petitioners have challenged the order passed by the Mamlatdar, Taluka Sayla, District Surendranagar.
2. Mr.
S.P. Majmudar, learned advocate for the petitioners does not press this petition at this stage with a liberty to approach the appropriate authority as indicated by the respondents in its reply dated 14.10.2011.

It is, however, quite clear from the facts of this petition that the impugned order dated 31.5.2011 is challenged by the present petitioner by way of filing this writ petition which came to be registered on 2.9.2011 and the said petition has remained live before this Court till today. As and when the appeal is filed, the appellate authority shall consider the said period as having approached this forum and take the said fact into consideration while considering the issue in detail in filing the appeal as contemplated under Section 203 of the Bombay Land Revenue Code.
4. With these observations, the petition is disposed of as not pressed at this stage. Direct service is permitted.
