This appeal was filed by Ram Piyarey son of Jagdhar and Ram Lakhan son of Mitthu against the judgment and order dated 28.09.1991 passed by Special Judge, Gorakhpur in S.T. No.284 of 1990.
On 18.07.2018, as none appeared for the appellants, bailable warrants were issued against the appellants, fixing 29.08.2019.
Pursuant to the above order, the Chief Judicial Magistrate, Gorakhpur has submitted report dated 16th August, 2019 stating therein that the appellant no.1 (Ram Piyarey) died about 12 years back and the appellant no.2 (Ram Lakhan) died on 14.06.2019.
The above report is supported by statement of witnesses recorded in an inquiry conducted by the Chief Judicial Magistrate, Gorakhpur.
In view of the above, the appeal stands abated. Let the record of the court below be sent back.
