Heard Sri Naresh Kumar Pal, learned counsel for the petitioner and Sri Brajendra Kumar, Advocate on behalf of respondent no.3.
The present writ petition has been filed challenging the order dated 15.2.2019 passed by the Deputy Director of Consolidation in Revision No. 194 of 2018 filed under Section 48 (1) of the Consolidation of Holdings Act, 1953.
It reflects from the record that certain objections were decided by the Consolidation Officer and the petitioner was granted a single chak over his original holding i.e. Plot No. 311. Aggrieved by the order of Consolidation Officer, Dharmendra Kumar respondent no.3 filed an appeal being Appeal No. 69 under Section 21 (2) of the Act which was allowed vide order dated 30.5.2018 and the petitioner was allotted a single chak over his original holding of Plot no. 311/6 and 313/3 valuation of 67.32 paise having area of 0.842 hectares. Against that order, the petitioner filed a revision was which dismissed vide impugned order dated 15.2.2019. Before the revisional authority, the petitioner made a demand that his chak be extended towards south side and the drainage (nali) in between chak nos. 311 and 313 be abolished. The Deputy Director of Consolidation has recorded a specific finding that a single chak has been allotted to the petitioner over his original holding i.e. Plot No. 311/6 and 313/3 and in case the demand of the petitioner is accepted and the drainage (nali) is abolished then several chakholders will be deprived for getting irrigation facilities.
I do not find any illegality or infirmity in the order impugned. The writ petition, lacks merit and is accordingly dismissed.
