JUDGMENT / ORDER

Hon'ble Rajesh Chandra,J.
Heard the learned counsel for the appellant, Sri Maneesh Tripathi for the Respondent No. 4 and learned Chief Standing Counsel for the Respondents No. 1 to 3.
This appeal is directed against the order of the learned single Judge dated 10.5.2010 by which the writ petition was finally disposed of with the direction to the petitioner to deposit the entire amount back in a particular manner directly with the respondent Bank then half of the collection charges was also directed to be paid.
At the very outset, learned counsel for the appellant submits that in similar set of facts, this Court disposed of Special Appeal No. 519 of 2010 in a particular manner by which the directions given by the learned Single Judge to deposit half of the collection charges has been set aside. A copy of the order passed by this Court on 26.4.2010 in Special Appeal No. 519 of 2010 has been annexed as Annexure 2-A to the writ petition.
In view of the aforesaid, by following the order passed by this Court, we dispose of this special appeal by giving liberty to the petitioner to deposit the due amounts with the respondent Bank without deposit of any recovery charges.
We also quite make it clear that if the amount is not paid as per schedule as given by the learned Single Judge then the appellant will not be entitled to get benefit of this order and the Bank/authorities will be free to proceed in accordance with law.
The special appeal stands disposed of accordingly.
