Heard learned counsel for the petitioner and Sri Raj Deo Singh, learned Central Govt. Counsel appearing on behalf of respondent Nos. 1 and 3.
The petitioner stood guarantor for the repayment of loan of another employee of the U.P. Postal Primary Cooperative Bank Limited where the petitioner is an employee. The employee for whose loan the petitioner stood guarantor is one R.S.Pandey. He is said to have been removed from service vide order dated 05.02.2009. Now, by the impugned notice dated 27.11.2019, the U.P. Postal Primary Cooperative Bank Limited is proceeding to recover the outstanding loan amount of Rs. 8,22,140/- from the petitioner. The learned counsel for the petitioner does not dispute the fact that he stood surety for repayment of the loan. This being so, there is no infirmity in the impugned notice dated 27.11.2019.
The petition fails and is, accordingly, dismissed.
It will, however, be open to the petitioner to recover from the principal borrower by filing a suit for indemnification or seeking any such remedy as he may be advised.
