Heard learned counsel for the petitioner.
Petitioner is aggrieved by a notice dated 1st June, 2010 issued by the Manager (P.& A.), British India Corporation Limited, Branch Imili, Kanpur Nagar, informing the petitioner that as per the records of the company, petitioner shall attain the age of superannuation on 30th June, 2010.
Various facts and pleas have been raised for disputing the correctness of the notice issued qua the date of retirement of the petitioner.
The Hon'ble Supreme Court of India has repeatedly held that no dispute with regard to the date of birth recorded in service book is to be entertained at the fag end of the servicemen.
I am of the considered opinion that petitioner being an industrial worker can always raise an industrial dispute qua his date of retirement.
Accordingly, the present writ petition is dismissed with liberty to the petitioner to raise an industrial dispute.
