Heard Shri Akhilesh Kumar Singh, learned counsel for the petitioner.
Learned counsel for the petitioner prays for and is permitted to implead the Divisional Commissioner, Azamgarh in the array of the respondents as respondent no. 4 today itself.
A counter affidavit has been filed by Shri Satendra Pratap Singh, learned counsel for the respondents. In paragraph 3 thereof it is stated that the competent authority to sanction pension and pensionary benefits is the Commissioner of the Division. It is also stated that so far as the payment of earned leave is concerned, a cheque of Rs.2,88,266/- has been issued in favour of the petitioner.
No useful purpose would be served in keeping this writ petition pending.
This writ petition is therefore disposed of with a direction to the respondent no. 4-Divisional Commissioner, Azamgarh to take a decision with regard to retiral dues of the petitioner in accordance with law within a period of two months from the date of receipt of the certified copy of this order.
It is made clear that the court has not adjudicated the claim of the petitioner on merit.
