Heard learned counsel for the petitioner and Sri Ramesh Pundir, learned Standing Counsel for the State- respondents.
According to learned counsel for the petitioner there is already an injunction order in his favour from the Civil Court and despite direction having been issued by the Civil Court to the police authorities to ensure its compliance, the local police is not ensuring compliance of the order of the Civil Court. In this respect, the petitioner has also represented the Superintendent of Police, Basti vide representation dated 19th July, 2018 (Annexure No. 6 to the writ petition), which is said to be still pending.
Considering the facts and circumstances of the case, we dispose of this petition with direction to respondent no. 4 to take an appropriate decision on the pending request of the petitioner, referred to above, strictly in accordance to law, within a period of four weeks from the date of production of certified copy of this order, after affording opportunity to the petitioner and the private respondents.
