Heard Mr. Sunil Kumar, learned counsel for petitioner, learned Standing Counsel representing respondents-1 and 2 and Mr. Aditya Yadav, Advocate holding brief of Mr. Shivam Yadav, learned counsel representing respondent-3.
Petitioner has filed present writ petition under Article 226 of the Constitution of India for a writ of mandamus commanding respondent-2 to decide Case No. T-201803410109768/18 (Ram Swaroop Vs. State) under Section 144 of U.P. Revenue Code, 2006 within time bound period fixed by this Court.
At the very outset, learned Standing Counsel has raised a preliminary objection by submitting that afore-mentioned suit is a declaratory suit. However, petitioner has not disclosed the stage of above-mentioned suit. On the aforesaid premise, learned Standing Counsel submits that present writ petition is liable to be dismissed at this stage.
When confronted with above, learned counsel for petitioner could not overcome the same.
In view of above, present writ petition fails and is liable to be dismissed.
It is, accordingly, dismissed at this stage.
