Heard learned counsel for the petitioner and the learned Standing Counsel.
With the consent of the parties, the writ petition is disposed of at the admission stage itself.
The sole submission of the learned counsel for the petitioner is to expedite the application under Order 39 Rule 1 read with Section 156 C.P.C., which is pending since September 2017 in Original Suit No. 339 of 2017 (Ram Swaroop vs. Lal Ji and others) before Civil Judge (Jr. Division), Pilibhit.
In view of the aforesaid, it would serve no purpose to keep the writ petition pending, and therefore the writ petition is disposed of by directing the respondent no. 1 Civil Judge (Jr. Division), Pilibhit to expedite/decide the application under Order 39 Rule 1 read with Section 156 C.P.C., in Original Suit No. 339 of 2017 (Ram Swaroop vs. Lal Ji and others) within a period of four moths from the date of production of certified copy of this order in accordance with law.
It is clarified that this Court has not adjudicated upon the merits of the claim as raised by the petitioner in the present writ petition.
