Sri Siya Ram Sahu, learned counsel for the appellant submitted that the sole appellant Ram Swaroop Sahu has been died.
From perusal of the record, it is evident that the report of the Chief Judicial Magistrate dated 21.1.2020 is on record which is supported with the certificate of Aneet Yadav -Sabhasad and the statement of Kallu Prasad Sahu. The report of Sub Inspector Neeraj Kumar Yadav of concerned police station has also been appended with the report. In above both statements, it has come that no family member of the deceased could be find. In the statement of Kallu Prasad Sahu, it has come that he is the complainant on whose complaint the present criminal proceedings were initiated.
The statements of the complainant and Aneeta Yadav-Sabhasad of the same village are on record along with the report of Sub Inspector Neeraj Kumar Yadav. On the basis of the report of Chief Judicial Magistrate concerned supported with the above evidences, it is found that the sole appellant Ram Swaroop Sahu has been died, so the appeal against the sole appellant Ram Swaroop Sahu stands abated.
The sureties and bail bonds are hereby discharged.
