JUDGMENT / ORDER

Heard learned counsel for the applicants and the learned AGA and perused the record.
The learned counsel for the applicants submitted that the applicants and the respondent no. 2 are on inimical terms. A civil litigation between them is already going on. The son of the applicant no. 1 had instituted a complaint at Kanpur in which summoning order was passed, which was challenged in a petition before this Court at Allahabad and the proceeding of the complaint has been stayed.
The instant case happens to be a counterblast of the complaint case filed by the son of the applicant no. 1. The learned counsel for the applicant further submitted that the story as stated in the complaint is absurd and false. He next submitted that it is a no injury case.
Notice on behalf of respondent no.1 has been accepted by the learned AGA. Issue notice to respondent no.2 by registered post for which necessary steps may be taken within two days.
Counter affidavit if any may be filed within four weeks and rejoinder affidavit, if any, within two weeks thereafter.
List immediately after expiry of the aforesaid period.
Till the next date of listing no coercive process shall be issued and executed against the applicants Ram Swarath Verma and Alok Verma in Complaint Case No. 240 of 2010 (Ram Dutt v Ram Swarath) under sections 323, 393, 504 and 506 IPC, P.S. Maharajganj, District Faizabad pending in the court of the I-Judicial Magistrate, Faizabad.
