Present writ petition has been filed for quashing the orders dated 12.04.2018 and 9.12.2017 passed by the Authority Payment of Wages Act, 36 and Assistant Labour Commissioner, Ghaziabad and further prays that not to rely realize the amount in pursuance of orders dated 9.12.2017 and 1.2.2018.
Mr. Vijai Sinha, learned counsel appears for respondent No. 5 has raised preliminary objection that against the order in question, statutory appeal lies under Section 17 of the Payment of Wages Act, 1936.
Learned counsel for the petitioner could not deny this fact, therefore, this writ petition is dismissed on the ground of alternative remedy with liberty to the petitioner to approach the Appellate Authority in accordance with law.
