(C.M.A. Nos.93626/09- Delay; 93627/09- Abatement; 93628/09- Substitution.) Heard.
There is an application on behalf of legal heirs of opposite party no.3 that the petitioner nos.5, 6 and 7 have died in February 2011, September 2016 and January 2018, but no steps have been taken for substitution of legal heirs. Opposite party no.3 has also died in January 2003 and the application for substitution was filed in 2009 after delay of six years.
Learned counsel for the petitioners Sri Sampurna Nand, Advocate says that he has intimated the remaining petitioners vide letter dated 5.12.2018 for taking requisite steps, but nobody has responded.
Steps for notice upon the legal heirs of opposite party nos.2 and 3 have also not been taken..
In view of the above the writ petition stands abated. It is dismissed.
