Heard learned counsel for the petitioner and learned Standing Counsel.
This writ petition has been filed for issuance of mandamus commanding the respondent no.1-Deputy Director of Consolidation, Ballia to decide the Restoration Application No. 489/519 registered as Case No. 1028 of 2009 (Ram Dahin and another Vs. State of U.P. and others) within stipulated time.
The contention of learned counsel for the petitioner is that against ex parte order dated 18.03.1982, petitioner filed recall application in 2009 for recalling the said order. Several dates have been fixed but no final decision has been taken by the Deputy Director of Consolidation till date.
Under these circumstances, direction is issued to respondent no.1-Deputy Director of Consolidation, Ballia to decide the Restoration Application No. 489/519 registered as Case No. 1028 of 2009 (Ram Dahin and another Vs. State of U.P. and others) as expeditiously as possible, preferably, within a period of six months from the date of production of certified copy of this order.
Writ petition is, accordingly, disposed of.
