JUDGMENT / ORDER

Hon'ble Dinesh Kumar Singh,J.
1. Heard.
2. Notices on behalf of opposite parties no.1 and 2 have been accepted by learned Chief Standing Counsel.
3. For the order proposed to be passed, we do not find it necessary to issue notice to opposite party no.3, as such, notice to opposite party no.3 is dispensed herewith.
4. The instant writ petition has been filed seeking following reliefs:
"I) Issue a writ, order or direction in the nature of mandamus commanding to the opposite party no 3, to release the payments in compliance to the order dated 27/11/2019, passed by the Committee headed by the District Magistrate, by which it is decided that insurance company will pay the benefits under Mukhyamantri Kisan Evam Sarvhit Bima Yojana to the petitioner.
II) issue a writ, order or direction in the nature of mandamus commanding to the opposite party no 2, to take necessary action against the opposite party no.3, in accordance to the provisions of the scheme in order to ensure the compliance of order dated 27/11/2019, as sufficient time has been passed and in spite of that opposite party no.3 is not acting according to the provisions of the scheme.
III) Issue any other order or direction may kindly also be passed which the Hon'ble Court deems fit, just and proper under the facts and circumstances of the case.
IV) Cost of the writ petition may also be awarded to the petitioner."

Learned counsel for the petitioner submits that the petitioner has applied for the benefit of Mukhyamantri Kisan Evam Sarvhit Bima Yojna and has completed all the necessary formalities in this regard. The claim of petitioner has been considered by the District Level Committee headed by District Magistrate on 27.11.2019 and a decision has been taken to make payment of the required amount under the said scheme to the petitioner. The decision of the District Level Committee is annexed as Annexure-1 to the writ petition in which the name of the petitioner finds place at serial no.4.
6. It is submitted that in spite of the aforesaid decision, the petitioner has not been paid the compensation till date.
7. We have considered the submissions made by parties' counsel and gone through the records.
8. In view of above, writ petition is disposed of finally with the direction to the opposite party no.2/District Magistrate, Ambedkar Nagar, who is the head of the District Level Committee that in case the claim of petitioner is found admissible and the decision dated 27.11.2019 has been taken for payment of compensation to the petitioner, then he shall ensure the payment of due amount to the petitioner in accordance with law expeditiously, say, within a period of six weeks, if possible from the date a certified copy of this order is placed before him.
