By means of the present petition, the petitioner has raised grievance that in the village till date no consolidation has taken place under the Consolidation of Holdings Act, 1953 in the revenue Village Nevada Mukhlispur, Tehsil Badlapur, District Jaunpur and, therefore, the villagers could not get the benefit of the consolidation scheme.
The petitioner submits that they have already moved application on 17.12.2018 before the Consolidation Commissioner, U.P., Lucknow in the above regard.
In the considered opinion of the Court the matter is required to be examined by the Consolidation Commissioner and to pass appropriate orders on the application of the petitioner. However, it is made clear that before any order is passed the Consolidation Commissioner will necessarily require to have report from the District Magistrate concerned regarding the grievance of the petitioner and after seeking comment from the District Magistrate only, he will pass orders. The necessary action shall be taken by the Consolidation Commissioner within three months from the date of submission of certified copy of this order.
