Ram Sumer vs Shri Ambika Chaudhary

High Court Of Judicature at Allahabad|30 April, 2018
|

JUDGMENT / ORDER

Court No. - 59
Case :- CONTEMPT APPLICATION (CIVIL) No. - 1771 of 2018 Applicant :- Ram Sumer Opposite Party :- Shri Ambika Chaudhary, Tehsildar Counsel for Applicant :- Daya Shankar
Hon'ble Yashwant Varma,J.
Heard learned counsel for the applicant.
This petition alleges disobedience of an order dated 13 April 2017 which had commanded the concerned Tehsildar to dispose of proceedings referable to Section 34 of the U.P. Land Revenue Code, 1901 preferably within a period of four weeks.
From a perusal of the order sheet, it is evident that there has been no wilful or inordinate delay in disposal of proceedings so as to compel this Court to hold the opposite party in contempt. The Court further notes that short dates are being fixed in the matter, and it was last called on 6 April 2018. Consequently, this Court finds no ground to initiate proceedings in contempt at this stage.
The petition is accordingly dismissed.
It is however left open to the applicant to approach the Court again in case the matter is inordinately delayed.
Order Date :- 30.4.2018 Arun K. Singh
