Heard learned counsel for the petitioner and perused the record.
By means of this writ petition under Article 227 of the Constitution, the petitioner has prayed for following relief:-
"i). Direct the learned Civil Judge (Jr. Division), Shahganj, Jaunpur to decide the application 6C dated 02.07.2020 filed in Original Suit No.453 of 2020 (Ram Subhag vs. Nirmala Devi and others) within stipulated period, pending since 2020."
Accordingly, this petition is disposed of with a direction to the court concerned to consider and decide the aforesaid 6C application filed by the petitioner under Order 39 Rule 1 & 2 of Code of Civil Procedure, 1908 read with Section 151 of Code of Civil Procedure, strictly in accordance with law and after recording satisfaction regarding service of summons and giving full opportunity of hearing to the appearing parties, as expeditiously as possible preferably within a period of two months positively from the date of production of copy of this order.
It is provided that a copy of the order available on the official website of the High Court will be taken to be authentic one.
