Disciplinary action has been initiated against the petitioner and from the instructions obtained by Sri Shravan Kumar Dubey, learned Additional Chief Standing Counsel the Governor has granted sanction to initiate disciplinary proceedings in terms of Article 351-A of the Civil Service Regulations. In such circumstances, withholding of petitioner's gratuity cannot be objected to. Petitioner otherwise is paid provisional pension.
So far as difference of Seventh Pay Commission is concerned it is stated that after the budget is received the amount of Rs.94,194/- shall be released. 90% amount towards GPF has also been paid.
In the facts of the present case, this writ petition is disposed of with a direction upon respondents to release the amount towards difference of Seventh Pay Commission Report, within a period of four months from today. The payment of gratuity and balance 10% amount of GPF shall abide by the disciplinary proceedings initiated against the petitioner. All attempts would be made to conclude the disciplinary enquiry within a period of six months from the date of presentation of a copy of this order.
