JUDGMENT / ORDER

Court No. - 59
Case :- CONTEMPT APPLICATION (CIVIL) No. - 1091 of 2018 Applicant :- Ram Siromani Opposite Party :- Vimal Kumar Dubey, Sub Divisional Officer Counsel for Applicant :- Dharmendra Kumar Yadav,Mohan Lal Pandey
Hon'ble Yashwant Varma,J.
Heard learned counsel for the applicant.
A writ petition preferred by the applicant seeking expeditious disposal of the suit instituted under Section 229-B of the U.P. Zamindari Abolition & Land Reforms Act 1950 was disposed of with a direction to the Sub Divisional Officer to endeavor to decide the same within a period of four months.
From a perusal of the order sheet, it is evident that on as many as 20 occasions the suit could not be taken up for disposal on account of lawyers abstaining from work.
In view of the above, this Court does not find any ground to hold the opposite party in contempt.
The petition is therefore dismissed subject however to the observation that the concerned Sub Divisional Magistrate shall endeavor to decide the suit expeditiously without granting unnecessary adjournments.
