In somewhat identical facts and circumstances, another writ petition being Service Single No.30890 of 2017 (Shiv Balak Vs. State of U.P. and others) has been disposed of on 19.12.2017, vide following orders:-
"Heard learned counsel for petitioner and learned standing counsel for State.
Petitioner has filed present writ petition claiming that his services from 01.08.2014 to 22.09.2016 is required to be counted in his regular service started from 23.09.2016 on the post of Assistant Teacher. For the said purpose, petitioner has moved representation dated 16.08.2017 before the opposite parties, but the same is pending till date.
Learned counsel for petitioner submits that grievance of petitioner would be met, in case representation of petitioner is decided in a time bound manner.
Learned counsel for opposite parties have no objection to the same.
In view thereof, petitioner is permitted to make a fresh detailed representation to opposite party no. 3, Basic Shiksha Adhikari, Gonda, raising all his grievance, annexing therewith a copy of this writ petition and all the documents in support of his claim within a period of three weeks from today along with a certified copy of this order.
In case such a representation is moved by petitioner, opposite party no. 3 Basic Shiksha Adhikari shall consider and decide the same in accordance with law by a reasoned and speaking order within a period of three months from the date a certified copy of this order along with representation is placed before him.
It is made clear that this court has not expressed its opinion on the merits of the case and all questions are left open to be considered and decided by the competent authority in accordance with law.
With the aforesaid directions, the writ petition is disposed of."
Petitioners have also represented in the matter on 11.1.2018, which is stated to be pending.
This writ petition is also disposed of with a direction upon the authority concerned to decide the petitioners' representation, in accordance with law, within a period of three months from the date of presentation of certified copy of this order.
