At the very outset the learned counsel for the petitioner prays for and is granted leave to amend the array of parties i.e. Project Manager, U.P. Bridge Corporation Ltd., Moradabad Unit, Moradabad as respondent no. 5 during the course of the day.
Shri Thaukr Azad Singh, Advocate has filed his power on behalf of respondent no. 4 which is taken on the record.
It is the case of the petitioner that he was appointed as Mason on 30.1.1977 and thereafter promoted to Group -B on 01.04.1985 and also regularized by the Corporation. He retired after attaining the age of superannuation on 28.02.2017. He has been given certain amount of Gratuity from the date of his regularization till 2001 to 2017 but he has not been paid his Gratuity amount when he was working as daily wage/work charged employee. He has made several representations, the last of which was of 22.11.2018 but no heed has been paid by the respondents.
Since the representation has been made by the petitioner lastly on 22.11.2018 to the Project Manager the newly impleaded respondent, the respondent no. 5 shall take appropriate action and submit his report to respondent no. 2.
The respondent no. 2 shall thereafter coordinate with the respondent no. 5 and make payment of admissible dues to the petitioner in accordance with law.
The entire exercise be completed by the respondent no. 2 and 5 within a period of two months from the date a certified copy of this order is filed before the respondent no. 2.
