Heard learned counsel for the petitioner and learned Standing Counsel for the State respondents.
The present writ petition has been preferred against the order dated 6.11.2020 passed by the Secretary, Prayagraj Development Authority, Prayagraj against the petitioner in respect of two storied buildings and shops etc., and measuring about 300 sq.meters of the petitioner situated East, Y 11 Chak, Harihar, Leelapur, Prayagraj being land nos. 6,11,12,13,14, Bandhwa, Tahirpur, Jhusi, Prayagraj.
Learned counsel for the contesting respondent has raised a preliminary objection regarding maintainability of the writ petition on the ground that against the order impugned, the petitioner has got efficacious alternative remedy to prefer an appeal under U.P. Urban Planning and Development Act, 1973.
Once the efficacious alternative remedy is available to the petitioner then there is no reason or occasion for us to bypass the statutory forum.
Accordingly, the present writ petition is disposed of.
The party shall file computer generated copy of such order downloaded from the official website of High Court Allahabad, self attested by the petitioner alongwith a self attested identity proof of the said person (preferably Aadhar Card) mentioning the mobile number to which the said Aadhar Card is linked.
The concerned Court/Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
