Heard learned counsel for the applicant, learned AGA for the State and perused the record.
This application under Section 482 Cr.P.C. has been filed with the prayer to quash the charge-sheet dated 31.7.2019 as well as further proceeding of Special Case No. 138 of 2019, State Vs. Ram Shekhar & others) arising out of case crime no. 463 of 2019, under sections 306, 376, 120 IPC and section 3(2)V SC/ST Act, P.S. Kalan, District Shahjahanpur pending in the court of Addl. Sessions Judge, Court No. 2 Shahjahanpur.
However, as requested, the applicant is permitted to appear before the concerned court within a month from today and move an application claiming discharge. The concerned court shall after hearing, decide the application on merits, in accordance with law, within a period which shall not exceed a period of three months from today.
With the aforesaid directions, this application is finally disposed of.
