Heard learned counsel for the petitioner and learned Standing Counsel for the State.
The only submission made by Sri S. C. Pandey, learned counsel for the petitioner is that the fair price shop licence of the petitioner was suspended by order dated 7.5.2018 wherein certain charges of malpractices in running of the fair price shop were laid out. The only contention of Sri S. C. Pandey, learned counsel for the petitioner is that the petitioner refutes the charges laid out against him. He contends that the charges are false and actuated by malice. Lastly he submits that to show his bonafides, the petitioner is prepared to join the enquiry and clear his name.
It is open to the petitioner to tender his reply to the show cause notice along-with supporting evidence, if any, within a period of three weeks from today. In case such reply is received within the stipulated period the authorities shall decide the matter on merits after independent application of mind in accordance with law.
The authorities shall decide the matter within three months of the date of receipt of a certified copy of this order along-with the reply to the show cause notice.
It is clarified that in case petitioner fails to submit a reply along-with supporting evidence, if any, within a period of three weeks from today, the directions issued herein will stand recalled automatically With aforesaid observations present writ petition stands disposed of.
