This application under Section 482 Cr.P.C. has been filed for quashing the entire proceeding of criminal Case No. 2674 of 2017, State Versus Ram Shakal and others, under Sections 147, 323, 504, 506, 427 I.PC., Police Station Pakari, District Ballia, pending in the court of Additional Chief Judicial Magistrate II, Ballia registered on cognizance following the charge sheet No. A/29/17 dated 29.07.2017, arising out of Case Crime no. 301 of 2017 under sections 147, 323, 504, 506, 427 I.P.C., including the order dated 20.09.2017 passed A.C.J.M. II, Ballia.
The charge sheet dated 29.07.2017 is impugned in the instant application. The Investigating Officer after investigation and collecting credible evidence has filed charge sheet. It appears that the applicants are not cooperating with the trial court. Disputed questions of fact cannot be gone into under Section 482 Cr.P.C.
The application is, accordingly, dismissed.
