Heard Shri S.S. Yadav, learned counsel for the petitioner; learned Additional Chief Standing Counsel for the State respondents and Shri B.P. Singh, learned counsel second and fourth respondents.
Petitioner is before this Court with the request commanding the respondents for ensuring the salary of Rs.68,000/- in place of Rs.66,000/- for the post of Head Master, Junior High School w.e.f. 02.07.2015.
At the very outset, the parties are with the agreement that the controversy in hand has already been settled by the Division Bench of this Court in Special Appeal Defective No.318 of 2017 (Raj Kumar Yadav and others vs. Mr. Nand Lal Ram and others) and as such, it is requested that the present matter be also decided on the same terms.
In view of the above, with the consent of parties, the present writ petition is disposed of asking the District Basic Education Officer, Azamgarh to look into the grievance of the petitioner and pass appropriate order in accordance with law, especially in the light of Raj Kumar Yadav (supra), preferably within a period of three months from the date of production of certified copy of this order.
It is made clear that the Court has not considered the claim and contention of the petitioner on merit.
