By means of this writ petition, the following relief has been prayed for -
"issue a writ, order or direction in the nature of mandamus commanding the respondent no. 1 (Tehsildar), Tehsil-Padrauna, District Kushinagar to consider and decide Restoration Application dated 13.10.1998 filed in Case No. T199805440100005 (Hansdev vs. Gandhi) under Section 34 of U.P.Z.A. & L. R. pending since 13.10.1998 within short stipulated time to be fixed by this Hon'ble Court."
It is stated that a restoration application for recall of an order passed in favour of the respondent in proceedings under Section 34 of the U.P.Z.A. & L.R. Act is pending consideration since the year 1998.
In the aforesaid facts and circumstances, this writ petition is disposed of with the direction that the respondent no.1 Tehsildar, Tehsil-Padrauna, District Kushinagar may endeavour to decide the restoration application expeditiously, preferably within a period of three months from the date a certified copy of this order is filed before him.
