The only prayer made in the instant petition is for issuance of a direction to the trial Court to decide Matrimonial Case No. 407/2015, under Section 13 of the Hindu Marriage Act, 1955, within a time specified by this Court.
The proceedings have been initiated by the petitioner. A perusal of the order sheet reveals that on 25.11.2016, application filed by the opposite party under Section 24 of the Act was allowed, and the petitioner was directed to pay interim maintenance to the opposite party @ Rs. 4000/- per month, apart from litigation expenses.
On 19.3.2018, counsel for the petitioner was required to clarify as to whether the order of interim maintenance is being complied with by the petitioner or not.
Today, when the matter was taken up, he has made a statement that on every date fixed in the case, litigation expense of Rs. 200/-, as directed by order dated 25.11.2016 is being paid. However, he is not certain whether interim maintenance of Rs. 4000/- is being paid or not.
Having regard to these facts, the instant petition is disposed of with direction to the Court below to ensure due compliance of the order of the interim maintenance, in case, it is still in subsistence and is validly enforceable, and also ensure disposal of the proceeding, having regard to the provisions of Section 21-B of the Act.
