Heard learned counsel for the appellant and learned A.G.A for the State on the Delay Condonation Application.
The grounds of delay mentioned in the affidavit filed in support of delay condonation application is sufficient. Hence, the Delay Condonation Application is allowed.
Office is directed to allot regular number to the appeal.
Office report indicates that this Court has summoned the lower court record vide order dated 19.4.2018 but till date same has not been received.
In view of the above, office is further directed to send a reminder to the District Judge Jhansi requisitioning the lower court record within two weeks.
List this case after two weeks before the appropriate Bench. The matter shall not be treated as part-heard/tied up by this Bench.
