By order dated 31.08.2016 in Writ C No. 40921 of 2016 filed by the applicant, a direction was issued to respondent No. 2 to the writ proceedings to take appropriate decision on the pending proposal of gram sabha dated 17.10.2013, within 10 weeks from the date of receipt of certified copy of the order.
The resolution of gram sabha dated 17.10.2013 was in favour of the applicant for being appointed as fair price shop dealer in the village.
On matter being taken up today, Sri P.K. Giri, learned Additional Chief Standing counsel has placed on record an order passed by Sub-Divisional Officer on 25.07.2018. According to the said order, the resolution was passed by gram sabha dated 17.10.2013 in the favour of the applicant, as the license of the fair price shop dealer was cancelled. But in an appeal filed by the said dealer, the appeal was allowed and the order of cancellation has been set-aside. Thus, the resolution passed in favour of applicant was rendered meaningless and accordingly no action was taken on its basis.
Since, the proposal in favour of the applicant for being appointed as fair price shop dealer was on account of the fact that the license of the original dealer had been cancelled but which in course of time, stood restored, therefore, this Court does not find any good reason to proceed further in the instant contempt proceedings. The contempt application is accordingly consigned to record.
