The husband of the petitioner Hari Om, who was a farmer died due to snake bite on 08.09.2016. Accordingly, petitioner preferred a claim under the Mukhyamantri Kisan Evam Sarvhit Bima Yojana.
The said claim has been rejected by the District Magistrate, Sambhal vide order dated 02.08.2019 by detailed and a speaking order on the ground that the claim of the petitioner was not available in the office, the petitioner was given several opportunities to present a fresh claim but she failed to do so and as such the claim has become barred by time.
The petitioner by means of this writ petition seeks a direction upon the District Magistrate, Sambhal to decide his claim dated 19.08.2019 in accordance with Government Order dated 20.06.2017.
The claim of the petitioner has already been rejected on 02.08.2019 and, therefore, no further claim in that regard is permissible.
The petitioner contends that she has submitted a fresh claim on 19.08.2019 pursuant to the order dated 13.08.2019 of this Court passed in the contempt proceedings. If that be so, petitioner may press his aforesaid claim before the District Magistrate in accordance with law.
The writ petition is disposed of accordingly.
