The grievance of the petitioners is that their land being gata no.336 area 0.0785 hectare has been acquired by the respondent no.3 for widening of the National Highway No.91. However, no compensation has been paid as yet. The petitioners, for redressal of their grievance, have made a representation dated 27.09.2017 before the competent authority but no decision has been taken as yet.
It is contended by the learned counsel for the petitioners that their land cannot be taken by the respondents without paying the compensation in accordance with law.
We have heard the learned counsel for the petitioners, learned Standing Counsel and Sri Alok Krishna Tripathi, learned counsel for the respondents.
Taking into consideration the facts and circumstances of the case, we are of the view that the ends of justice would be subserved by granting liberty to the petitioners to make a fresh representation along with a certified copy of this order before the respondent no.1 within two weeks. If such a representation is made, the respondent no.1 shall make endeavour to decide the same within three months.
Needless to say that we have not adjudicated the matter on the merit of the case and the authority concerned shall pass an appropriate order independently in accordance with law.
Accordingly, the writ petition is disposed of.
