JUDGMENT / ORDER

1. Heard learned counsel for the parties.
2. The petitioners' Writ Petition No.27380 (S/S) of 2018 was finally disposed of vide judgment and order dated 10.04.2019 as under:-
"Petitioners no. 1,2 & 3 have retired from service on 30-11-2012,31-05-2013 and 01-08-2015, but, they have not been paid their gratuity till date to which they are entitled.
Learned counsel for petitioners submits that grievance of petitioners would be fully sufficiently met in case representation of petitioners is considered and decided by respondent no. 3 in a time bound manner.
In view of aforesaid and without entering into merits of the case, petitioners are permitted to make a fresh representation to Respondent no. 3, District Basic Education Officer,Pratapgarh annexing therewith copy of the present writ petition, its annexures, any other document in support of their case alongwith certified copy of this order within a period of three weeks from today. In case, such a representation is made by petitioners, respondent no. 3, shall consider the same and pass appropriate orders thereon in accordance with law within a period of two months from the date a certified copy of this order is placed before him.
With the aforesaid, writ petition is disposed of."

3. Pursuant to issuance of contempt notice, an affidavit of compliance of Mr. Ashok Kumar Singh, District Basic Education Officer, Pratapgarh has been tendered today in the Court, which is taken on record.
Along with the aforesaid compliance affidavit, copy of decision/order dated 26.08.2019 passed by the District Basic Education Officer, Pratapgarh has been placed on record as Annexure-1. It has been specifically stated in the said order dated 26.08.2019 that the petitioner is not entitled for gratuity.
4. In view of the aforesaid decision dated 26.08.2019, taken on the representation of the petitioner, nothing survives in this contempt petition, which is dismissed as having been rendered infructuous.
Contempt notice stands discharged.
However, if the petitioner is aggrieved by the decision dated 26.08.2019, it would be open to him to impugn the same, in accordance with law, before the competent Court/authority, if he is so advised.
