This writ petition has been filed seeking the following relief:-
"(I) Issue a writ order or direction in the nature of Mandamus commanding the respondent no.2 i.e. Sub Divisional Magistrate, Tehsil Phoolpur, District Allahabad to decide the declaratory suit no. nil of 2013 (Ram Sajeevan vs. Jeet Lal and others) filed under Section 229B of U.P.Z.A. and L.R. Act pending before respondent no. 2 expeditiously if possible within stipulated period to be fixed by this Hon'ble court and further to direct the respondents to registered the aforesaid case after deciding the question maintainability."
It has been stated that a suit filed by the petitioner under Section 229-B of the U.P.Z.A. and L.R. Act for declaration is pending consideration for determining the issue of its maintainability since the year 2014.
Under the circumstances, this writ petition is disposed of with a directing the court concerned to determine the question of maintainability of the suit expeditiously and positively, within a period of three months from the date a certified copy of this order is filed before him.
