The submission of learned counsel for the petitioners is that the petitioners were appointed as Gram Panchayat Adhikari and taking into consideration the hard work and honestly, the petitioner no.1 has been given officiating charge of Panchayat Industries Inspector on 09.08.2010 in district Ambedkar Nagar and the petitioner no.2 has been given officiating charge of Panchayat Industries Inspector on 02.08.2010 in district Gonda for a period of one year. The Director, Panchayati Raj, U.P., Lucknow by means of letter dated 27.07.2011 asked the District Panchayat Raj Officers, Ambedkar Nagar and Gonda to submit the production and sell report of the petitioners. In pursuance to the letter dated 27.07.2011, the District Panchayat Raj Officers, Ambedkar Nagar and Gonda submitted statement of progress report of the petitioners on 31.07.2011 and 01.08.2011 before the opposite party no.2 for consideration regarding extension of term of the petitioners on the post of Panchayat Industries Inspector.
The further submission of learned counsel for the petitioners is that it appears that without deciding the issue with respect to extension of term of the petitioners on recommendation of the District Panchayat Raj Officers, the impugned order has been passed saying that the further period has not been extended and, therefore, the petitioners be directed to work as Gram Panchayat Adhikari.
Learned Standing Counsel is directed to seek instruction as to whether any decision has been taken by the Director, Panchayati Raj, U.P., Lucknow in pursuance to the recommendation sent by the District Panchayat Raj Officers, as contained in Annexure-6 to the writ petition.
List this case in the week commencing 06.02.2012 along with Writ Petition No.551 (S/S) of 2011.
