Heard Mr. Dhirendra Pratap Singh, learned counsel for the applicants, and the learned A.G.A. for the State.
This application under Section 482 Cr.P.C. has been filed challenging the entire proceedings of Complaint Case No. 288 of 2014 (Ram Rekha Sharma Vs. Ram Sagar Sharma and others) under Section 323, 392, 504, 506 IPC, Police Station Gola, District Gorakhpur.
Learned counsel for the applicant submits that the applicants were summoned in the above mentioned complaint case, vide summoning order dated 29.9.2014. He, further, submits that the interest of justice shall be served in case the court below is directed to consider the bail application of the applicants sympathetically.
The Court finds that even though summoning order was passed on 29.9.2014, applicants have not yet appeared before the court below, even though a period of more than three years and six months have rolled by.
Consequently, no case for interference is made out. The application is, accordingly, dismissed.
